The petitioner seeks bail in Bakhtiyarpur P.S. Case No.56 of 2019 vide Special Case No.1517 of 2019 registered for the offence under Sections 30(a)/34/ 36/37© of Bihar Prohibition and Excise Act.
Accusation is that on receipt of secret information about selling of illicit liquor at the house of co-accused Nitish Kumar in village Tejabigha, the informant along with other police officials reached there and searched the house. At that time two persons started fleeing away but both were apprehended who disclosed their name as Anoj Thakur (petitioner) and Nitish Kumar and on search one LPG cylinder, one oven fitted with steel pipe and regulator, one aluminium pot
Patna High Court CR. MISC. No.23329 of 2019(2) dt.11-04-2019 2/2 containing molasses, one teen of 14 liter teemed with liquid molasses, one empty plastic gallon and 12 liter country made liquor kept in plastic jerking were recovered. Learned counsel for the petitioner submits that petitioner is not the family member of the co-accused Nitish Kumar rather he was apprehended by the police there. The petitioner was merely present near the house of the petitioner. Further submissions is that petitioner having no criminal antecedent is in custody since 10.02.2019.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the Special Judge-Excise, Patna in Bakhtiyarpur P.S.
