JUSTICE SUDHIR SINGH ORAL ORDER 10-02-2016 Learned counsel for the petitioners is permitted to make necessary correction in para 12 of the application. Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Purnahiya P.S.Case No. 72 of 2015 instituted under Sections 302, 201, 326/A, 34 of the Indian Penal Code. The allegation against the petitioners is that they killed the son of the informant and the dead body of his son was found in the field of sugarcane.
It has been submitted on behalf of the petitioners that they have no criminal antecedent. The petitioners have been made accused in this case only on the basis of suspicion. There is no circumstantial evidence to suggest the implication of the
Patna High Court Cr.Misc. No.51035 of 2015 (3) dt.10-02-2016 2/2 petitioners in the present case It is submitted on behalf of the State that the petitioners are named in the FIR and there is suspicion against them because of previous dispute.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheohar in connection with Purnahiya P.S.Case No. 72 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
