The petitioner seeks bail in Mojahidpur ( Babarganj) P. S. Case No. 272 of 2018 instituted for the offence under Section(s) 379/411 and 461 of the Indian Penal Code. Learned counsel for petitioner submits that petitioner is not named in the written report. During investigation, it has come that one mobile phone bearing I.M.E.I. No. as mentioned in the written report was recovered from possession of this petitioner. The petitioner was using the SIM number 7294818275 issued in his name.

Learned counsel for petitioner submits that no TIP was held of the aforesaid mobile which is said to have been recovered from possession of this petitioner. Learned counsel

Patna High Court CR. MISC. No.24103 of 2019(2) dt.15-04-2019 2/2 further submits that petitioner has purchased the aforesaid mobile from one Bindeshwari Mandal for consideration amount of Rs. 1,000/-.

Petitioner is in custody since 2.1.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Bhagalpur, in connection with Mojahidpur ( Babarganj) P.S. case no. 272 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
