The petitioner apprehends his arrest in connection with Katihar Complaint Case No. 2028 of 2017 registered under Section 498(A) of the Indian Penal Code.

Learned counsel for the petitioner submits on the joint prayer of learned counsel for the petitioner and the opposite party no.2, the matter was referred to the Mediation Centre, Patna High Court, Patna, for settlement of dispute in between the petitioner and the opposite party no.2, who are husband and wife but the dispute could not be settled, as during mediation

Patna High Court CR. MISC. No.27704 of 2019(5) dt.20-11-2019 2/2 proceeding, while opposite party no. 2 went at her matrimonial house, but she returned from there.

On the other hand, learned counsel for the opposite party no. 2 submits that, in fact, opposite party no. 2 had gone to her matrimonial house during mediation proceeding and stayed there about two months but due to mishandling of her husband and other in-laws, she returned and now she wants one time settlement.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Katihar Complaint Case No. 2028 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
