The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per F.I.R., all the F.I.R. named accused persons including this petitioner abused and assaulted the informant and others. This petitioner is alleged to have assaulted elder son of informant by axe, due to which, he sustained injury on his head. It is submitted on behalf of petitioner that due to petty dispute, a simple Maarpit took place between the parties, in which, both sides sustained injury. The injury attributed to the petitioner is simple in nature. There is case and counter case. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.26251 of 2022(2) dt.20-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, District - Samastipur in connection with Bibhutipur P.S. Case No. 454 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
