Learned Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 325, 307, 354(B), 504, 506, 509/34 of the Indian Penal Code.

Prosecution case, in short, is that the accused persons including the petitioner abused and assaulted the informant and his son with iron rod, due to which they sustained injuries. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. No injury report is on the record to show whether the nature of injury is grievous or simple. In the said circumstances, it cannot be ascertained whether offence under Section 307 of I.P.C. is attracted or not.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. case No.184 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
