This application, for grant of anticipatory bail, arises out of Belchi Police Station Case No. 43 of 2016, disclosing offences under Sections 406, 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner has submitted the petitioner is innocent and has not committed any offence. In fact, the petitioner happens to be Head Master of the school has not defalcated any government money. The petitioner has utilized all the sanctioned money in construction of school building, which is evident from annexure-2. The petitioner has retired in the year 2015 and at that time he has handed over all the details regarding
Patna High Court Cr.Misc. No.33318 of 2017 (2) dt.20-07-2017 the utilization of government money to the then head Master but no complaint in this regard has been raised by any one and after lapse of one year, this F.I.R. has been lodged against the petitioner on forged and frivolous grounds. Hence, the petitioner also deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Barh, Patna, in connection with Belchi Police Station Case No. 43 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
