The petitioner has prayed for regular bail in a case instituted for the offence under Sections 302, 328, 120(B) of the Indian Penal Code and Sections 33, 34 and 36 of the Bihar Excise Prohibition Act, 2018. As per allegation in the FIR, due to consumption of poisonous liquor on 15.01.2022 three persons, namely, Bhago Mistri, Manna Mistri and Dharmendra Prasad died in suspicious circumstances and on same day five more persons died in hospital during treatment. Patna High Court CR. MISC. No.25895 of 2022(10) dt.19-05-2023 2/3 in business of illicit liquor. Apprehended accused Jitendra Paswan @ Bokra has disclosed the name of his associates including the petitioner also.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is languishing in judicial custody since 23.02.2022. Moreover, other co-accused has been granted bail vide Cr. Misc. No. 29889 of 2022. Learned APP appearing for the State has opposed the prayer of bail of the petitioner. Considering the facts aforesaid and the period under custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
