JUSTICE SHIVAJI PANDEY ORAL ORDER 03-11-2017 Heard learned counsel for the petitioner and learned counsel for the Union of India.

In the present case, petitioner has made a claim for payment of his dues for the construction of fountain and boundary wall with grill work and gate of CE/CD colony at Salimpur, Dumara, Patna during 2010-11.

For the aforesaid work the petitioner has entered into an agreement vide agreement no. 35/EE/PCD-J/2010-2011 and made statement that he has carried out the work but payment

Patna High Court CWJC No.10886 of 2017 (2) dt.03-11-2017 has not been made.

In such view of the matter, petitioner is directed to file an application before the Superintending Engineer, Patna Central Division, Central Public Works Department, Rajeev Nagar, Patna who will examine the case of the petitioner and make payment of admitted dues. If the Superintending Engineer is not agreeable to the claim of the petitioner, he will be obliged to give notice to the petitioner and after hearing he will pass a reasoned order.

With the aforesaid observation and direction this writ petition is disposed of.
