JUSTICE BIRENDRA KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363/364 of the Indian Penal Code.

Abhimanyu Sah, son of the informant, had gone along with this petitioner and thereafter he is missing. Case-diary does not reveal that any substantial material has been collected against the petitioner. However, the investigation is still going on. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail

Patna High Court Cr.Misc. No.52251 of 2016 (3) dt.09-02-2017 2/2 bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Supaul/Successor Court in connection with Tribeniganj Police Station Case No.149 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation of the case. In case some substantial material comes against the petitioner, the Court-below shall be at liberty to reconsider the cancellation of privilege of anticipatory bail.
