JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2017 This application is for grant of anticipatory bail in connection with Complaint Case No. 129 of 2017 registered for the offence(s) under section(s) 323, 341, 452, and 380 of the Indian Penal Code.
Allegation against the petitioners is of snatching of chain and assaulting the informant and others. Submission of the learned counsel for the petitioners is that the dispute arose between the parties due to "Chajja" and for that, some hot altercation took place and the petitioners have falsely been implicated in this case.
Heard learned Additional Public Prosecutor also.
Patna High Court Cr.Misc. No.33870 of 2017 (2) dt.20-07-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed. Let the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks, be released on bail on their furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Patna City in connection with Complaint Case No. 129 of 2017, subject to the condition as laid down under Section 438 (2) Cr. P.C. Further condition is that the petitioners shall cooperate in the investigation of the case and make themselves available before the police as and when required and in the event of failure on their part to appear before the police on two consecutive occasions, their bail bond shall be liable to be cancelled.
