The petitioners apprehend their arrest in Bihar P.S. case No. 259 of 2016 under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that while she was sitting in her house the petitioners and others suddenly came and assaulted the informant and others with iron rod. She further alleged that Uday Kumar used to tease her.

The learned counsel for the petitioners submits that there is counter version being Bihar P.S. case No. 258 of 2016 against Ajit Kumar, the brother of the informant and his family. It is submitted that earlier two cases, i.e., Bihar P.S. case No. 322 of 2013 under Section 323 and other Sections of the IPC as well as

Patna High Court Cr.Misc. No.49707 of 2016 (2) dt.22-12-2016 2/2 Bihar P.S. case No. 143 of 2008 under Section 323 and other Sections of the IPC were lodged by Punam Kumari, informant of the present case, and her mother Gita Devi. The petitioners are next door neighbour of the informant and the occurrence took place on account of throwing of garbage. The injuries found on the person of injured are simple in nature.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar P.S. Case No. 259 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
