JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 401, 413, 414 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Firoz Alam. No incriminating material has been recovered from the conscious possession of the petitioner. Similarly situated coaccused persons have already been allowed bail by a coordinate bench of this Court vide paragraph 9 of the bail petition.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in Kochadhaman Police Station Case No. 66 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
