Petitioners apprehend their arrest in connection with a case registered under Sections 323, 341, 504, 506, 448, 354, 380 and 34 of the Indian Penal Code.
Allegation in brief is that the petitioners entered into the house of the informant and looked after he son and it is alleged that the petitioner no.1 outraged her modesty and the accused persons threatened the informant and her son not to interfere in the land dispute.
Submission is that the petitioner no.1 is full brother of the informant's husband and there is land dispute between both
Patna High Court Cr.Misc. No.38990 of 2017 (2) dt.21-08-2017 2/2 sides as the F.I.R. itself is mentioned the proceeding relating to Section 107 of the Code of Criminal Procedure. The rest other petitioners are brother-in-law of petitioner no.1 and petitioner no.3 is the friend of petitioner no.1. They have no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Sanjay Poddar, Sunil Poddar and Ranjeet Poddar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No.221 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
