This application for grant of regular bail arises out of Agrer P.S. Case No. 101 of 2019, disclosing offences punishable under Section 387 of the Indian Penal Code.

The informant has alleged in the First Information Report that the petitioner was demanding extortion money to the tune of Rs. 5 lacs through his mobile and was threatening to kill one Danish.

Learned counsel for the petitioner has submitted that the petitioner and the informant are co-villagers and he has been falsely implicated. He has submitted that except the allegation as disclosed in the First Information Report, there is no material to substantiate that any demand whatsoever was made by the

Patna High Court CR. MISC. No.26808 of 2020(2) dt.19-10-2020 2/2 petitioner as alleged in the FIR. The petitioner is in custody since 15.11.2019. On perusal of paragraph 3 of the application, it is noted that the petitioner has criminal antecedent. However, in view of the fact that the petitioner is in custody since 15.11.2019 on the basis of only allegation that he was demanding extortion money under the threat of life, a case for grant of regular bail is made out.

This application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IX-cum-ACJM, Sasaram, Rohtas in Agrer P.S. Case No. 101 of 2019.
