Petitioner apprehends his arrest in connection with Bhagwanpur P.S.Case No. 209 of 2016 registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 436, 504 and 379 of the Indian Penal Code.
Allegation against the petitioner is of assault by iron rod to Shivalak Sahni, causing injury to him.
Submission of learned counsel for the petitioner is that co-accused persons having similar allegation have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 11.7.2017 passed in Cr.Misc.No.25611 of 2017. Heard learned APP also.
Having heard both sides and view of the fact that
Patna High Court Cr.Misc. No.14075 of 2018 (2) dt.10-04-2018 2/2 similarly situated co-accused persons have been granted privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Vaishali, in connection with Bhagwanpur P.S.Case No. 209 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
