The petitioner apprehends his arrest in Complaint case No. 337 of 2015 for the offence allegedly committed by the petitioner under Section 498A of the IPC.

The complainant alleged that she was married with the petitioner in the year 1994 and she gave birth to a female child, who is aged about 19 years. She alleged that after marriage her husband and other in-laws always subjected her to physical and mental torture and she is living in her parents' house only with an object that behaviour of her husband would be reformed.

The learned counsel for the petitioner submits that this

Patna High Court CR. MISC. No.23578 of 2019(2) dt.11-04-2019 2/2 is the second round of litigation. Firstly, his wife filed complaint case in the year 1997 which was quashed in the year 2000. The petitioner is still ready to keep his wife. The complainant does not want to live with petitioner at Ranchi although the petitioner is ready to keep her on any undertaking.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that marriage was solemnized in the year 1994 and since long the wife is living in her Naihar, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Patna City, Patna in connection with Complaint case No. 337/ 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
