The petitioner apprehends his arrest in Belhar P.S. Case No. 81/2017, registered for the offences punishable under Sections 147, 149, 323, 308, 504 and 506 of the Indian Penal Code. The accusation is that on 15.05.2017 in the morning, nine persons including the petitioner variously armed with weapon came at the Basa of the informant Puran Yadav and began to abuse. When the informant protested, this petitioner assaulted with iron rod on the head of the informant, thereafter he fell down. Learned counsel appearing on behalf of the petitioner submits that in fact due to land dispute occurrence of Marpit took place in which father of petitioner Jangli Yadav sustained grievous

Patna High Court Cr.Misc. No.39768 of 2017 (2) dt.14-09-2017 2/2 injury regarding which Belhar P.S. Case No. 82/2017 has been instituted on the same day.

Having considered the facts and circumstances and the fact that there is specific allegation against the petitioner that he assaulted the informant with iron rod on his head and the injury found on the person of the informant is grievous in nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
