The present application has been filed for recall of the order dated 16.10.2015 by which Cr. Misc. No. 44985 of 2015 was dismissed for non-prosecution.

Learned counsel for the petitioner submits that due to some misconception he could not appear resulting in such dismissal and prays that the case be restored as there was no deliberate or willful laches on his part.

Upon considering the facts and circumstances of the case and submissions of the learned counsel for the parties, the order dated 16.10.2015 passed in Cr. Misc. No. 44985 of 2015 is recalled and the case stands restored to its original file and number.

The application stands disposed off.
