The matter has been listed out of turn on prayer made by the petitioner's counsel for directing the Authorities to dispose of his representation (Annexure 23), wherein claim has been made for permission to submit joining.
Learned counsel for the State points out that in response to an Advertisement published in the year 2007, the petitioner was issued appointment letter for a short term contractual employment as a support/auxiliary staff for the district/block level office in the Bihar Education Project at
Patna High Court CWJC No.17530 of 2013(2) dt.29-07-2019 2/2 Darbhanga. Appointment letter is dated 05.06.2008 and contains clear stipulation that the same shall be a short term contract for a period of one year. On basis of appointment letter dated 05.06.2008, the instant writ petition has been filed in September, 2013.
The facts are such that the petitioner has no enforceable claim on the basis of appointment letter dated 05.06.2008 since the period of short term contractual engagement has come to an end way back in the year, 2009, at least four years prior to the filing of this writ petition. Writ petition stands dismissed.
