The petitioner in this case prayed for stay of the departmental proceeding.

The sole contention of the petitioner is that in view of pendency of criminal case, almost on same facts, the departmental proceeding should be stayed till the disposal of criminal case.

Patna High Court CWJC No.7380 of 2014 (5) dt.28-07-2017 2/2 dismissed holding that there can be no straight jacket formula that the departmental proceeding cannot continue till disposal of the criminal case. On 23.07.2014 this case was ordered to be listed after disposal of CWJC No. 437 of 2014 and other analogous cases.

It appears that after disposal of CWJC No. 437 of 2014 and other analogous cases, the petitioner has lost interest in pursuing this case.

This writ petition is, accordingly, dismissed for non prosecution.
