JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2017 The petitioners are apprehending their arrest in connection with Gopalganj P.S. Case No. 142 of 2017, registered for offences punishable under Sections 467, 408, 471, 420 and 120(B) of the Indian Penal Code.

Allegation against the petitioners is of cheating the informant and others by taking money from them on the assurance of providing job in the foreign country.

It has been submitted on behalf of the petitioners that during the investigation, it has come in the case diary that it is the informant, who has collected the money and he has not handed over the money to the petitioners and petitioners have falsely been implicated in this case.

Heard learned A.P.P. also.

No.38329 of 2017 (2) dt.19-08-2017 Having heard both sides, considering the facts and circumstances of the case, nature of allegation, I am not inclined to grant the petitioners the privilege of anticipatory bail, let petitioners surrender before the court below and make prayer for regular bail and if any such application is filed, the court below after considering the submissions of learned counsel for the petitioners and also the materials available in case diary, shall pass an appropriate order, without being prejudiced by the order of this Court.

With the above observation, this application is disposed of.
