Apprehending his arrest in Gogri P.S. Case No. 40 of 2017 registered under sections 420, 468, 409 and 471 lodged by the Circle Officer, the petitioner has prayed for bail. It is submitted that the petitioner did not constitute the monitoring committee who deceitfully and fraudulently recommended the names of the ineligible persons for the relief grants. Learned counsel submits that the petitioner is one of the beneficiaries of the flood relief grants. In course of investigation, it revealed that an amount of Rs. 6000/- was deposited twice in his account. As soon as he became cognizant of the same, a sum of Rs. 6000/- was re-deposited in the office of the Circle Officer vide receipt at Annexure-2. He further

Patna High Court Cr.Misc. No.46564 of 2017(2) dt.21-09-2017 2/2 submits that if in course of investigation the authority finds that he was not even entitled to Rs. 6000/-, he would be ready to redeposit the same to the State authority. The petitioner has no criminal antecedents.

In the facts and circumstances of the case, let the petitioner above named in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Shri Brajesh Kumar, Judicial Magistrate, 1st Class, Khagaria in Gogri P.S. Case No. 40 of 2017 on condition that one of the bailors shall be his own/close family members.
