ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
Learned counsel for the petitioners submits that the petitioner no. 2, namely, Jitendra Kumar Ram @ Jitendra Kumar has already been taken into custody and, therefore, the application as against him has become infructuous, which is, accordingly, dismissed as infructuous.
So far as other petitioners are concerned, they are apprehending their in connection with Durgawati P.S. Case No. 117 of 2015, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.
Patna High Court Cr.Misc. No.51892 of 2015 (2) dt.22-01-2016 2/2 Learned counsel for the petitioners submits that there is a general and omnibus allegations against these petitioners and also there is case and counter case between the parties. It is further submitted that these petitioners have no criminal antecedent, they may be granted the privilege of anticipatory bail. Considering the aforementioned facts and circumstances and that the person against whom the specific allegation was made has already been taken into custody, let the petitioners, namely, (i) Shesh Nath Ram, (iii) Chottu, (iv) Shyam Narayan Ram and; (v) Roshan Kumar in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs.
10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Durgawati P.S. Case No. 117 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
