Petitioners apprehend their arrest in connection with Sour Bazar P.S.Case No. 408 of 2016 registered for the offences punishable under Sections 366 and 366A/34 of the Indian Penal Code.
Allegation against the petitioners is of kidnapping of daughter of the informant.
Submission of learned counsel for the petitioners is that her statement under Section 164 Cr.P.C. shows that there is no allegation against petitioner No.1 and she has made some
Patna High Court Cr.Misc. No.14078 of 2018 (2) dt.10-04-2018 2/2 allegation against petitioners Nos. 2 to 4 but she has married petitioner No.1 on her own sweet will and now she is pregnant also and a compromise petition has been filed in the court below. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S.Case No. 408 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
