The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 169 of 2015 registered under Sections 341, 323, 420, 467, 504 and 306/34 of the I.P.C. The accusation is that informant got registered the sale deed in respect to Plot No. 659 of Khata No. 280 on 27.02.1984. She constructed three storied building on the half portion of the purchased land and the rest was vacant. In the three storied constructed house, son of the informant used to reside and some portion was on the rent. The petitioner, who is the son of the informant, got mutated his name in the Jamabandi committing forgery in the document and also sold the 570 squire feet of the

Patna High Court Cr.Misc. No.36537 of 2016 (2) dt.16-09-2016 2/2 vacated land to the accused Bina Devi.

Learned counsel appearing on behalf of the petitioner submits that admittedly, petitioner and one Sunil Kant are the own son of the informant and due to misunderstanding, the present case has been lodged against the petitioner by the informant, who is mother of the petitioner.

Further submission is that complainant/informant is also filed the Title Suit No. 279 of 2015 for setting aside the sale deed, which is said to be executed by the petitioner in favour of co-accused Bina Devi in the Court of SubJudge-1, Patna City. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City, Patna in connection with Bahadurpur P.S. Case No. 169 of 2015, arising out of Complaint Case No. 1151 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
