JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 26-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P. for the State through video-conferencing. The petitioner has preferred this application for grant of regular bail in a case registered u/s 302, 365, 201 and 120B of the Indian Penal Code.

As per the prosecution case, the informant 's father was a night-guard in S.N. Sinha College and earlier the informant's father had given Rs. 4 lakhs by way of advance to the petitioner Bhola Singh and the co-accused Shishupal Singh for purchase of a land but after sometime, he denied to purchase

Hence, the informant's father requested the petitioner Bhola singh and the co-accused Shishupal Singh to return the advance money. It is further alleged that the petitioner and the co-accused called the informant's father for returning the advance money and since then the informant's father is missing. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is accused in two other criminal cases which are not related to murder as stated in para 3 of the bail petition. It is further submitted that the co-accused Shishupal Singh has already been granted bail by a co-ordinate Bench vide order dated 30.03.2022 passed in Cr. Misc. No. 57465 of 2021 and the case of the petitioner is similar to that of the co-accused. The petitioner is in custody since 01.03.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of this case, the petitioner is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Nawada in connection with S.T. No. 292 of 2021, C.I.S. No. 292 of 2021 arising out of
