No. 9328 of 2015 before the learned Sessions Judge, Bettiah, which is pending adjudication. He has submitted that the said application has been filed in the light of the observations made by a Bench of this Court in its order dated 22.09.2015 passed in

Patna High Court Cr.Misc. No.52798 of 2015 (2) dt.22-12-2015 2 / 2 Cr. Misc. No. 38132 of 2015.

In view of the aforesaid submissions, a prayer has been made to withdraw the present application in order to press the modification application before the court below itself. The prayer is allowed.

The application is dismissed as withdrawn.
