The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 419 and 34 of the Indian Penal Code and section 10 of the Bihar Conduct of Examination Act, 1981.

As per allegation in the F.I.R., it is stated that another accused sat in place of this petitioner in the examination hall while giving examination.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations as levelled in the F.I.R. are false and concocted. He is in custody since 24.3.2021 and has no criminal antecedent. The application for bail is opposed by learned A.P.P.

Patna High Court CR. MISC. No.33522 of 2021(2) dt.06-08-2021 2/2 for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of allegation and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Industrial P.S. Case no. 51 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur.
