2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323, 324, 307, 379, 504 and 34 of the Indian Penal Code .

3 . As per the prosecution case , informant namely Munna Sahni alleged that on 02.05.2024, while he along with his brother, were coming to his house , in the meantime , all the accused persons including this petitioner and other 6 unknown persons armed variously surrounded informant and his brother and assaulted them. It is further alleged that petitioner gave

Patna High Court CR. MISC. No.29257 of 2025(2) dt.14-05-2025 2/3 knife blow on the head of brother of informant due to which he sustained head injury. It is further alleged that co-accused Sudhir Mahto took Rs. 49,200/- from the pocket of informant and snatched his motorcycle .

4. Learned counsel for the petitioner submits that both parties are food sellers and due to petty dispute , this false and concocted case has been lodged. Allegation of assault is general and omnibus against this petitioner. Doctor has found the injury simple in nature . Rest of the allegations are ornamental in nature to make the case grave . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the nature of injury , clean antecedent of petitioner and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Motihari East Champaran in connection with Dumariyaghat P.S. case No. 93 of 2024 , subject to the conditions laid down under section 438(2) of the Code of
