2. Heard leaned counsel for the State and learned counsel for the State Health Society.

The present writ petition has been filed for quashing the order contained in letter no. 6703 dated 14.08.2012 issued under the signature of State Programme Officer (respondent no. 4) whereby and whereunder a decision was taken to award bid no. PR-5397(NI-NI)-11-12 dated 27.08.2011 for supply of coloured
Patna High Court CWJC No.16737 of 2012 dt.19-08-2016 2/2 bed sheet (Satrangi Chadar) in Medical College, District, SubDivisional, Referral and Primary Health Centre in the State of Bihar; and for connected reliefs.

Learned counsel for the State and learned counsel for the State Health Society state that on 16.09.2011, technical bid of all the tenderers was opened by the Technical Committee and after scrutiny, all three firms/agencies were found technically qualified and hence, final bid of the said agencies were opened and the rate was finalized. The contract was applicable for a period of three years from the date of award of the same, which has already elapsed.
5. In that view of the mater, the prayer in the writ petition has been rendered infructuous by efflux of time and no positive relief can be granted at this belated stage.
6. The writ petition is accordingly dismissed as having become infructuous.
