JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2023 The present writ petition has been filed seeking the following relief:- "1.(i) For stay of the publication of final result of selection on the post of Constable vide Advertisement No.

01/14 which has been conducted by Central Selection Board, Patna and for issuance of direction to respondent authority to stop arbitrary measurement and humiliation of candidate after passing the written and physical test

Patna High Court CWJC No.17952 of 2015(2) dt.21-09-2023 2/3 and farther direct to respondents to take fresh measurement of the petitioner and supply the original Video-graph C.D. which has been prepared during measurement test and further for appointment of petitioner on the post of Constables."

At the outset, the learned counsel appearing for the respondent-Central Selection Board of Constable, Bihar, Patna submits, by referring to the counter affidavit filed in the present case, that in the category of the petitioner i.e. Backward Class Female Non Home Guard (BCF-NHG), while the marks secured by the last selected candidate is 105, the petitioner had secured only 102 marks, hence she has not been selected.

The aforesaid contention, advanced by the learned counsel for the respondents, has not been refuted by the petitioner, inasmuch as no rejoinder affidavit has been filed.

Having regard to the facts and circumstances of the case and considering the

Patna High Court CWJC No.17952 of 2015(2) dt.21-09-2023 3/3 aforesaid submission made by the learned counsel for the respondents, I do not find any merit in the present writ petition, hence the same stands dismissed.
