JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in Beur P.S. Case No. 90 of 2022, registered for the offence punishable under Sections 30(a), 36, 41 and 44 of the Bihar Prohibition and Excise Act.
962.43 litres of liquor has been recovered from ground floor of the house which was given to the tenants on rent.
It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner has been made accused in this case simply because he is husband of the house owner namely, Madhuri Sinha who has already been granted bail by this court vide order dated 20.05.2022 passed in Cr.
Patna High Court CR. MISC. No.25826 of 2022(2) dt.05-08-2022 2/2 Misc. No. 24473 of 2022. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court, Patna in connection with Beur P.S.
