The petitioner seeks bail in Special Case No. 4371/2017, arising out of Salimpur P.S. Case No. 118/2017, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that during patrolling duty informant received secret information that from Toofan Express liquor is being brought. The police reached at the place of occurrence. It is alleged that three bags were thrown from the running train, namely, Toofan Express near Bahadurpur. The police recovered 252 pieces of Jharkhand made liquor from those bags. The villagers disclosed the name of this petitioner and other accused persons to the police alleging that they are
Patna High Court CR. MISC. No.24115 of 2019(2) dt.15-04-2019 2/2 indulged in sale of illicit liquor.
Learned counsel for the petitioner has submitted that nothing has been recovered from conscious possession of petitioner.
Petitioner is in custody since 02.03.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Special Case No. 4371/2017, arising out of Salimpur P.S. Case No. 118/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
