JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case under sections 307 and other sections of the IPC and under section 27 of the Arms Act.

The allegation is that the petitioner gave sword blow on the head of informant.

Learned counsel for the petitioner submits that the injury caused by sword is simple in nature. He next submits that the instant case is counter of the earlier case namely, Bidupur P.S. case No. 410/2014 which has subsequently been converted into one under section 302 of the IPC and the petitioner has sustained injury in that case.

Having regard to the facts and circumstances of the

No.55906 of 2015 (3) dt.19-01-2016 2/2 case, let the petitioner, as named above, in the event of arrest/ surrender be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the lime amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. case No. 413/2014, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
