JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 149, 323, 307, 325, 427, 504 and 506 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that allegation against the petitioner is of assaulting Surendra Kumar with rod on his head. The injuries caused are simple in nature. The dispute arose due to petty issue of construction of latrine which was objected by the accused persons.

Having heard both sides, in view of the fact that there is case and counter case between the parties, injuries are simple in nature and the occurrence took place due to petty issue of

No.3250 of 2017 (2) dt.08-02-2017 2/2 construction of latrine, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gaya, in connection with Paraiya P.S. Case no. 55 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local one having property within the jurisdiction of the court concerned and petitioner shall cooperate in the investigation and make himself available before the police as and when required.
