Petitioner apprehends his arrest in connection with Mahisi P.S. Case No. 134 of 2016, registered for the offences punishable under Sections 341, 323, 308, 504, 506/34 of the Indian Penal Code and under Section 3/4 of Witch Prevention Act. The allegation leveled by the informant is that the petitioner used to humiliate the mother of the informant by labelling her as a witch. It is further alleged that the accused persons had blocked the exit passage of the informant house and subsequently, they had assaulted the informant and his family members, resulting in grievous injuries to them. Learned counsel for the petitioner submits that admittedly there is a previous dispute between the parties. On

Patna High Court Cr.Misc. No.32591 of 2017 (2) dt.13-07-2017 2/2 account of which the present case has been lodged against the petitioner. It is further submitted that the injuries pertaining to the present offence are simple in nature and the petitioner has clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to the petitioner.

Accordingly, let the abovenamed petitioner, in the even of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Saharsa, in connection with Mahishi P.S. Case No. 134 of 2016 subject to the conditions enumerated under Section 438 (2) of Code of Criminal Procedure.
