The petitioner seeks bail in Special Case No. 6120 of 2018, arising out of Salimpur P.S. Case No. 181 of 2018, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that total 36 litres of Jharkhand made country made liquor was recovered from NH 30 Four lane road.

Learned counsel for the petitioner has submitted that petitioner is arrested merely on suspicion. In the written report it is mentioned that petitioner was not apprehended on the spot. Petitioner is in custody since 22.02.2019.

Considering the aforesaid fact and circumstances, prayer

Patna High Court CR. MISC. No.23097 of 2019(2) dt.10-04-2019 2/2 of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna, in connection with Special Case No. 6120 of 2018, arising out of Salimpur P.S. Case No. 181 of 2018. Both the bailors will be close relative of petitioner.

From paragraph 3 of bail petition, it appears that other case of Excise Act are also pending against him. The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) khushbu/- U T
