2. Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 26.07.2024 in Cr. Misc. No.24224 of 2024.
3. The petitioner seeks bail, who is in custody since 09.08.2023 in connection with S.T. No.719 of 2023 (arising out of Amarpur P.S. Case No. 477 of 2020), F.I.R. dated 17.08.2020 registered for the offence punishable under Sections 341, 323, 302, 34 of Indian Penal Code.
4. Allegation against the petitioner is of committing murder of the informant's husband by means of assaulting.
5. Learned counsel appearing for the petitioner
Patna High Court CR. MISC. No.28539 of 2025(4) dt.11-07-2025 2/2 submits that the petitioner has clean antecedent. He submits that although the petitioner is in custody since 09.08.2023 but the trial is not concluded as yet.
6. Vide order dated 09.05.2025, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 15.05.2025 reveals that out of nine charge-sheet witnesses, four witnesses have been examined and the case is pending for the examination of the rest prosecution witnesses.
7. Considering the aforesaid facts and the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S.T. No.719/2023 arising out of Amarpur P.S. Case No. 477 of 2020 pending in the court of learned Additional Sessions Judge IV, Banka.
8. Prayer is refused.
9. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) anand/- U T
