2. The petitioner seeks bail in connection with Dalsingsarai P.S. Case No. 318 of 2023 registered for the offence punishable under Sections 457, 380 of the Indian Penal Code but charge has been submitted under Section 457, 380 and 411/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of committing theft.

4. Learned counsel for the petitioner submits that the petitioner was neither named in the F.I.R. nor any incriminating article has been recovered from his possession. The name of the petitioner has surfaced on the basis of confessional statement of co-accused Vikas Kumar. The petitioner is in

Patna High Court CR. MISC. No.24376 of 2025(2) dt.30-04-2025 2/2 custody since 09.11.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 318 of 2023, subject to the conditions that both the bailors shall be the close blood relative of the petitioner and he will co-operate in the trial.

8. The petitioner will also mark attendance in Kasimbazar Police Station District- Munger on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
