====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks anticipatory bail in connection with Parasbigha P.S. Case No. 61 of 2017, registered for the offence punishable under Sections 307, 379/34 and other allied sections of the Indian Penal Code.

The case of the prosecution, in brief, is that on account of drainage dispute, the petitioner and others had come to the place of the informant and started assaulting him with various weapons. It is further alleged that the petitioner was carrying a pistol and is said to have fired upon the informant side. The learned counsel for the petitioners submits that the present case is a case of land dispute, there is counter case also and no gun shot injury has been found on the person of the informant.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioner.

Accordingly, in the event of his arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jehanabad in connection with Parasbigha P.S. Case No. 61 of 2017 subject to the conditions laid down under Section 438(2) Cr. P. C.
