JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Baruraj P.S. Case No. 79 of 2017 registered for the offence punishable under sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is from a Bush behind the Bathan of this petitioner with which petitioner has no concern. petitioner's house is about 1.5 km away from the said place. Petitioner has no criminal antecedent. Case No. 79 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
