2. The petitioner seeks bail in a case registered for offence under Sections 341, 323, 380, 436, 504, 506/34 of the Indian Penal Code.
3. As per F.I.R., on 29.03.2021 at about 3.00 PM, this petitioner alongwith other co-accused person came to the house of informant, armed with rifle and started abusing informant. It is further alleged that the accused persons set the straw house of informant on fire in which 80 bags of paddy and 30 mounds of rice were also burnt.
4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. As a matter of fact, the prosecution party along others had committed dacoity in the
Patna High Court CR. MISC. No.27785 of 2024(5) dt.12-07-2024 2/2 house of petitioner and also committed murder of aunt of this petitioner, for which, Ghosi P.S. Case No. 56 of 1988 was lodged, in which, all the accused persons were convicted by the Court below, and due to that reason, the accused persons of aforesaid case and their family members had lodged several false case against petitioner's side and only with a view to give undue pressure upon the petitioner. Petitioner is in custody since 04.03.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 44 of 2021.
