The petitioner is apprehending his arrest in connection with Khusrupur P.S. Case No. 120 of 2015 for the offences instituted under Sections 302 and 34 of the IPC and 27 of the Arms Act.

The prosecution story that elder son of the informant saw that Ranjeet Kumar and Vivek Singh made fire as a result to which Tinku Kumar sustained injury whereas other accused persons made fire in air with an intention to create terror. The injured removed to the hospital where he was declared death. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no specific

Patna High Court Cr.Misc. No.51996 of 2015 (4) dt.19-02-2016 injury attributed against the petitioner and no specific overt has been alleged against him. The specific allegation has been made against the co-accused, namely, Ranjeet Kumar and Vivek Singh. The other co-accused, namely, Ravindra Singh who has similar allegation has already been granted anticipatory bail by this Court in Cr.Misc.No.6503 of 2016.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Khusrupur P.S. Case No.120 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Ashutosh Kumar Rai, J.M. Ist Class, Patnacity, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
