JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend arrest in connection with Daudnagar P.S. Case No. 03 of 2017 registered under Section 304(B)/34 of the I.P.C. pending in the Court of S.D.J.M., Daudnagar, Aurangabad.
Submission is that petitioners are innocent and have falsely been implicated in this case. They are father, mother-in-law and married Nanad.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioners by contending that there is specific allegation of assault against the petitioners
Patna High Court Cr.Misc. No.33362 of 2017 (7) dt.11-12-2017 2/2 and the injuries are also corroborated the prosecution version. Hence, they do not deserve anticipatory bail. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioners for anticipatory bail. Accordingly, this application is rejected.
