The petitioners apprehend arrest in Morhowrah P.S. Case No. 466 of 2017, instituted for the offence under Sections 147,148,149,341,323,324,325,307,504,506 of the IPC. Counsel for the petitioners has submitted that there is case and counter case between the parties. Counter case was filed by the petitioner side vide Morhowrah P.S. Case No. 467 of 2017 against the informant and his family members in which two persons of petitioner side sustained injury. Injury report of the aforesaid case has been enclosed as Annexure 3 to the counter affidavit. In the instant case, allegation against the petitioner is that they have assaulted the informant and his family members with other accused persons with iron rod.
Patna High Court Cr.Misc. No.12633 of 2018(3) dt.10-04-2018 2/3 Counsel for the petitioner has submitted that there are injuries sustained by both sides. He has also submitted that both the parties are on litigating term and have filed several cases against each other. It is further submitted that in the instant case both the parties have filed compromise petition in the Court below. In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners, named above, in the event of their arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Morhowrah P.S. Case No.
466 of 2017, to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra, subject to condition as laid down u/S 438 (2) of the Cr. P.C.
