2. The petitioner has prayed for bail in a case registered for the offence punishable u/s 364, 34 of the Indian Penal.
3. As per FIR, allegation against the petitioner along with co-accused persons is that they abducted son of the informant in the night of 10.05.2021 with intention to kill him but anyhow he saved himself.
4. It is submitted by learned counsel for the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. There in no eye witness of the alleged occurrence and there is no specific
Patna High Court CR. MISC. No.33219 of 2023(3) dt.04-10-2023 2/2 allegation levelled against the petitioner. As per statement of the victim recorded under Section 164 of the Cr.P.C., wherein he has not specifically supported the prosecution version. Similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 23.05.2023 passed in Cr. Misc. No. 5066 of 2023. It is further submitted that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 11.10.2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M., Ist Class, Muzaffarpur in connection with Baruraj P.S. Case No. 78 of 2021.
