JUSTICE BIRENDRA KUMAR ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/307/504/506/34 of the Indian Penal Code. The petitioner is full brother of the informant. For dispute of putting barricade the petitioner and others allegedly assaulted causing injuries to the informant. The doctor has found simple lacerated injury at the parietal region of the informant. Submission is that the background of allegation and the fact that the allegation is not specific as to who of the accused had caused single head injury, the petitioner deserves anticipatory bail.

Considering the aforesaid facts, the petitioner, above

Patna High Court Cr.Misc. No.45007 of 2016 (3) dt.19-01-2017 2/2 named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Katihar/Successor Court in connection with Barari Police Station Case No.156 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
