This application for grant of regular bail arises out of Town P.S. Case No. 196 of 2020, corresponding to GR No. 837 of 2020, disclosing offences punishable under Sections 399/403 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.

It is alleged in the First Information Report that on the basis of secret information that some persons had assembled to commit a crime, a raid was conducted by the police team, leading to recovery of certain incriminating materials. From the petitioner's possession two live cartridges were recovered. The petitioner is in custody since 15.03.2020. It has been stated in paragraph 3 of the application that the petitioner has no criminal

It has been argued on behalf of the petitioner that he has been implicated in the case without any basis and without following the procedure prescribed for search and seizure. Considering the above submission and the nature of accusation, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Town P.S.
