JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-12-2015 Heard the Counsel for the petitioner, the APP for the State and Mr. Awadhesh Kumar for the Bihar State Food and Civil Supplies Corporation.
The application seeks modification in the order dated 09.07.2015 passed in Cr. Misc. No. 25947 of 2015. It is stated that in the light of the said order, the petitioner surrendered and deposited 15 % of the misappropriated amount as depicted in the F.I.R. whereafter he was released on provisional bail for a period of 06 months which is going to expire in January, 2016. The petitioner has difficulty in doing so owing to the reasons spelt out in paragraph 5 of the application. It has been stated that the amount as ordered by this Court shall be deposited provided a period of one month time is extended and further no such application shall be filed.
Patna High Court Cr.Misc. No.53570 of 2015 (2) dt.16-12-2015 2/2 Considering the facts and circumstances of the case, the application is allowed. The period granted under order dated 09.07.2015 for deposit of second installment of the defalcated amount to be deposited by the petitioner is extended by one month. The period for which the petitioner shall remain on provisional bail as directed in the said order shall now be read as '07 months' in place of '06 months'.
The application is disposed of.
